• Please read these Terms & Conditions ("Terms", "Terms & Conditions") carefully before using the Omniaz Merchandise App 'OMT' mobile application (the "Service") operated by Omniaz Poland Sp. Z. o. o. ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

  ‍1.1. When you create an account with us, you must provide us with accurate, complete, and up-to-date information.
  1.2. You are solely responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

  ‍2.1. The Service is intended for use by individuals or entities who have a legal agreement with us or are our clients, and who are authorized by such agreements to access and use the Service.
  2.2. You agree not to use the Service for any illegal or unauthorized purpose, nor to violate any laws in your jurisdiction (including but not limited to copyright laws).
  2.3. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without the express written permission of Omniaz Poland Sp. Z. o. o.

  ‍3.1. Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service.
  3.2. By posting Content on or through the Service, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.

  ‍4.1. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
  4.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

  ‍5.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

  ‍6.1. These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
  
  7. Database License
  ‍7.1. The producer of the databases is Omniaz. Omniaz grants the user a license to use the database within the scope of its business activities.

  8. Use of Information in Images
  8.1. The user agrees that Omniaz may freely use the information provided in the images.
